General Information
In July, 2008 The Housing and Economic Recovery Act (Public Law 110-289) was enacted. Title V of the Law, “Secure and Fair Enforcement for Mortgage Licensing Act of 2008” or S.A.F.E. Mortgage and Licensing Act of 2008, established requirements for the licensing of Mortgage Loan Originators (MLOs). The S.A.F.E. Act requires MLOs to pass a qualified written test, to complete pre-licensure education courses, and to take annual continuing education courses. It requires the Nationwide Mortgage Licensing System and Registry or NMLS to approve pre-licensure and continuing education courses. The Act permits NMLS to charge reasonable fees in carrying out its requirements.

Pre-Licensure Education
All new applicants on or after 07/31/2009 must have completed 24 hours of NMLS approved pre-licensure education including 4 hours of NAMB or MBA approved courses before a license will be issued.
Existing licensees are encouraged to complete 24 hours of state approved pre-licensure education by 12/31/2009.
MLO's licensed prior to 07/31/09 are encouraged to continue to take state approved education from providers on the OFI website until further notice. |

Continuing Education
All licensees must complete at least 10 hours of NMLS approved continuing education including 2 hours of NAMB or MBA approved courses in 2010 in order to renew for 2011, unless PE was completed in 2010. |

SAFE MLO Test
All new applicants, on or after 07/31/2009, must pass the National and State Component of the SAFE MLO Test by 12/31/2010.
Existing licensees must pass the National and State Component of the SAFE MLO Test by 12/31/2010. |

Criminal Background Check
All licensees must submit fingerprints through NMLS for a criminal background check by 12/31/2010. |

Credit Report
All licensees must authorize a credit report through NMLS by 12/31/2010. |

Test Requirements
All licensed originators must obtain a passing grade on both the National and State Components of the test developed by the NMLS&R
All new applicants on or after July 31, 2009 must obtain a passing grade on both components of the test before obtaining a license
Originators which were licensed on or before July 30, 2009 must obtain a passing grade on both components by December 31, 2010
Originators which obtained a passing grade on or after January 1, 2004 on the Louisiana pre-licensing test previously administered by PSI Exams |
- Will be exempt from taking the state component of the test but must obtain a passing grade on the national component by December 31, 2010
- A passing score is 75% correct answers

SAFE Test Enrollment
In order to schedule tests with a Test Delivery Vendor, mortgage loan originators first must request and pay for a test enrollment window in NMLS by using the Test Enrollments and Test Enrollment Cart functions.

Testing Fees
Each MLO is required to pass a test which consists of two components: a National Component and Unique State Component. These fees are payable by an individual who is registering to take the MLO SAFE Test components or by the company which may be enrolling its MLO(s) for the test components.
NMLS has set the following fees for Test Administration. These fees will be in effect for 2010 and are subject to change.
National Component - $92 100 questions; appointment time: 3 hours
Louisiana Unique State Component - $69 55-65 questions; appointment time: 2 hours |
